Can I Change Compensation Lawyers?

What Legal Costs Will a Compensation Claim Incur?

We receive payment at the end of your case when your compensation is paid by the insurance company. We will inform you of our professional legal costs and the outlays incurred in your claim prior to settlement. Our legal fees will be deducted from the compensation paid into our Trust Account and the remaining funds will be transferred to your bank account.

What is No Win, No Fee?

What are the time Limits for QLD compensation claims?

The timeframe for damages for personal injuries must be commenced within 3 years of the injury occurring.

What is 50/50 rule?

The maximum amount of legal fees that you can be charged by a no win, no fee lawyer for compensation work in Queensland is 50%. The purpose of this rule is to ensure that you as an injured claimant always receives a fair share of the recovered compensation.

What compensation will I get for my compensation claim?

You are entitled to make a claim but you are not entitled to a particular fixed amount. This is why it is important to speak to our experienced compensation lawyers so we can evaluate your claim.

The following types of damages are available for your claim:

  • Past & Future Medical Expenses: Eg. Physio, GP consults, surgeries, medication and counselling

  • Past & Future Economic Losses : Eg. Time off work due to the subject accident injuries and loss on the basis that the injuries could affect work capacity

  • General Damage/Pain & suffering: Injuries will be assessed by independent medico-legal experts and given Whole Person Impairment. General Damage can be claimed in accordance with the Civil Liability Regulation.

  • Care & Assistance/Gratuitous/paid help around home:. eg. cleaning, cooking, laundry, hanging out the washing, mowing the lawn and etc.

Do I need to visit your offices to start a claim?

Not at all. We can visit you at your home or you are welcome to come to our Brisbane City office. We can have consultations over the phone, email or video conference to make it convenient for you and your family.

What does the insurance company fund?

If the insurance company has accepted liability for your claim or agreed to fund rehabilitation without admitting liability, the insurer will pay rehabilitation expenses provided they:

  • Are reasonable and appropriate

  • Relate to the injuries from the accident; and

  • Are validated eg. By providing receipts to the insurer

What is Whiplash Injury and What Treatment is Best?

Whiplash is an injury that occurs due to acceleration and deceleration forces experienced at high velocities. It is the most common injury in rear end car crashes where a car following another vehicle collides with the rear of the vehicle in front of it.

Whiplash injuries can affect all areas of the spine, including the neck, mid-back and lower back region. It can also affect other areas of the body such as shoulders and hips.

Various treatment options are available for whiplash injuries such as physiotherapy, exercise physiology, chiropractic and osteopath sessions and the reasonable cost of your rehabilitation will be funded by the insurance company.
